LEGAL NOTICE OF PUBLIC HEARING
The Posey County Area Plan Commission will hold a public hearing on Thursday, September 24, 2026, at 5:30 pm at the Posey County Community Event Center, 111 Harmony Township Road, New Harmony, IN 47631 (4H Fairgrounds) for the purpose of consideration of amendments to the Uniform Development Ordinance of the City of Mount Vernon, the Town of Cynthiana, the Town of Poseyville and Unincorporated Posey County (“UDO”) in the following manner:
1. To amend Chapter 2(B)(4)(c), Chapter 2(B)(5)(c), Chapter 2(B)(6)(e), and Chapter 4(C)(10)(e) of the UDO regarding Renewable Energy Generation Systems, SECS-3 (Tier 3 Solar).
2. To amend Chapter 3(B), Table 10 of the UDO to allow ground mounted signs as a permitted use in I-1 and I-2 Districts.
3. To amend Chapter 10(B) of the UDO regarding the definition of Lot Coverage.
4. To amend Chapter 2(B)(10)(c), Chapter 2(B)(11)(c) and Chapter 10(B) of the UDO regarding the definition and use of a Small Contractor Facility.
5. To amend the UDO to establish noise and transportation standards for I-1 and I-2 districts.
6. To amend the UDO to establish land use requirements for the location, construction and use of a data center.
7. To amend the UDO to establish land use requirements for the location, construction and use of battery energy storage systems (B.E.S.S.).
Written objections to the proposal that are filed with the Executive Director of the Area Plan Commission before the hearing will be considered. Oral comments concerning the proposal will be heard at the hearing.
The hearing will be continued to Thursday, October 1, 2026 at 5:30 p.m. at the Hovey House, 330 Walnut St., Mt. Vernon, IN 47620 and may be further continued from time to time as may be found necessary. The Complete information concerning the proposed amendments are on file in the Area Plan Commission office, First Floor, Coliseum Building, Room 132, Mt. Vernon, Indiana, Posey County.
