Order made pursuant to Indiana Code 36-7-9 and the Town of New Harmony Code of Ordinances, Chapter

Parcel Number: 65-26-01-010.000-007, commonly known as 1112 Lynnwood Ave, New Harmony, IN 47631.
In accordance with Indiana Code 36-7-9-4(a)(4) Unsafe Building and New Harmony Ordinance 2025-11, Minimum Maintenance Standards for Exterior Maintenance or Residential and Commercial Buildings and New Harmony Ordinance Chapter 9, 91.01.
Violations Cited
#1 General Exterior Condition: The exterior of a structure shall be maintained in good repair, structurally sound, and sanitary, and maintained in a manner that is not a threat to public health, safety, or welfare, nor become a public nuisance. All exterior walls shall be free of holes, breaks, and loose or rotting materials and shall be maintained waterproof.
#6 Accessory Structure: All yard barns or other accessory structures shall be maintained in compliance with property maintenance codes like any other structure.
#12 Roofs and Drainage: Roofs and flashing shall remain sound, tight, and free of defects that prevent rain infiltration.
Action Required
1. Repair or replacement of roofing in a manner that brings the structure into compliance with the Town’s standards;
2. Repair or replacement of exterior walls in a manner that is in compliance with the Town’s standards;
3. Repair or replacement of roofing to garage;
4. Repair or replacement of necessary members to make the structure waterproof in compliance with the Town’s standards;
5. Maintenance of yard in a manner that is in compliance with the Town’s standards.
Time Limit
Required action must be completed within forty-five (45) days after service of the order.
Hearing
The owner or those holding a fee interest, life estate interest, mortgage interest, or equitable interest of a contract purchaser of the property may request a hearing in writing to New Harmony Town Hall, 520 Church St, New Harmony, IN 47631 within 10 days of notice.
Failure to Comply
Failure to comply may result in the Enforcement Authority, through the town employees completing the work or contracting the work to be performed. Pursuant to IC 36-7-9, you will be held financially responsible for the costs of the work and related costs set out by the Statute, and Judgement may be entered against you for the costs. In addition, these costs may be certified to the Posey County Auditor for collection with property taxes. Such a judgement could constitute a lien against real estate and personal judgments are enforced. In addition, willful non-compliance could result in the imposition of a civil penalty from $0 to $5,000.
Duty to Notify of Transfer
Noncompliance with order following notice-liability for failure to give notice as to judgment against government entity.
A person or entity who has been issued and has received notice of an order relative to unsafe premises and has not complied with that order:
1. Must supply full information regarding the order to a person who takes or agrees to take a substantial property interest in the unsafe premises before transferring or agreeing to transfer that interest; and
2. Must within five (5) days after transferring or agreeing to transfer substantial property interest in the unsafe premises; and
a. The full name and telephone number of the person taking a substantial property interest in the unsafe premises; and
b. The legal instrument under which the transfer of agreement to transfer the substantial property interest is accomplished. IC 35-7-9-27
