POSEY COUNTY WESTERN BYPASS PHASE 1 EAST

POSEY COUNTY, INDIANA

Sealed proposals, or bids, for the “Posey County Western Bypass Project Phase 1 East” in Posey County, Indiana may be received in the office of the Posey County Auditor located at 126 E. 3rd Street, Room 220, Mt. Vernon, Indiana 47620, until 8:00 a.m. (CDT) on March 3, 2026 or must be delivered on March 3, 2026 no later than 9:00 a.m. (CDT) to the Board of Commissioners of Posey County at the Hovey House Hearing Room located at 330 Walnut Street, Mt. Vernon, Indiana 47620, at which time all bids will be publicly opened by the Board of Commissioners of Posey County and read aloud.

DESCRIPTION OF WORK: Work for which proposals are to be received includes Construction of a new corridor between Lower New Harmony Road and SR 69/Industrial Road, in Posey County, Indiana.

BID DOCUMENTS: Specifications, Contract Documents, and Plans are available for examination on or after 1:00 P.M. Wednesday, February 11, 2026 in the following office:

Bids shall be properly and completely executed on Bid Forms contained in the Contract Documents. Each Bid shall be accompanied by a proposal, itemized proposal, bid bond or certified check, a completely filled out Form No. 96 (Revised 2013), list of proposed suppliers and subcontractors, list of bidder experience, non-collusion affidavit, and acceptable bid security. Any Bid not accompanied by the aforementioned required items shall be deemed to be a non-responsive Bid.

No Bidder may withdraw the proposal within a period of 90 days following the date set for the receiving of bids. Posey County reserves the right to retain any and all bids for a period of not more than 90 days and said bid shall remain in full force and effect during said time. Posey County further reserves the right to waive informalities and to award the Contract to the Bidder providing the lowest responsible and responsive bid, all to the advantage of Posey County, or to reject all bids.

BID SECURITY: Each bid shall be accompanied by an acceptable certified check made payable to Posey County or an acceptable bid bond in the amount equal to five percent (5%) of the total bid price executed by an incorporated surety company in good standing and qualified to do business in the State of Indiana and whose name appears of the current Treasury Department Circular 570.

BONDS: A Performance Bond and Payment Bond each in the amount of 100 percent of the Contract price will be required from the Contractor to whom the work is awarded.

RETAINAGE: The OWNER shall retain ten percent (10%) of the amount of each payment until fifty percent (50%) of the work is complete. Retainage amount being held is not to exceed five percent (5%) of the total contract amount. On completion and acceptance of a part of the Work on which the price is stated separately in the Contract Documents, payment may be made in full, including retained percentages, less authorized deductions.

NON-COLLUSION AFFIDAVIT: The bidder is required to sign the Non-Collusion Affidavit as set forth in the contract documents.

INDIANA REQUIREMENTS: Standard Questionnaire Form 96 – Revised 2013, completely filled out and signed, including attachment of Contractor’s Financial Statement.
