NOTICE OF PUBLIC HEARING REGARDING THE

VACATION OF A PUBLIC WAY OR PUBLIC PLACE

Notice is hereby given that the Board of Commissioners of Posey County will conduct a public hearing and consider an Ordinance with regarding a Petition to Vacate a Public Way or Public Place, specifically a portion of a Drainage Easement, filed by the Petitioner, MJC Development, LLC.

The location of the County Roadway of Public Way to be vacated is in Posey County, Indiana and more particularly described as follows:

Part of a Drainage Easement granted by Document 196002948 (DB 80,pg 94), recorded in the Office of the Recorder of Posey County, Indiana, being part of the Southwest Quarter of the Northwest Quarter of Section Five (5), Township Seven (7), Range Twelve (12) West of the Second (2) Principal Meridian, Marrs Township, Posey County, Indiana, being more particularly described as follows:

BEGINNING at the Northwest Corner of the Southwest Quarter of the Northwest Quarter of said Section 5; thence along the North line of said quarter, quarter section, South 88 degrees 53 minutes 12 seconds East (bearings based upon Indiana West State Plane Coordinates (NAD83)) 214.61 feet to the Easterly line of the 125’ Drainage Easement recorded in Document No. 196002948 (DR 80, page 94) recorded in the Office of the Recorder of Posey County, Indiana; thence along said Easterly line and the Northerly line of said easement the next four (4) calls, (1) South 56 degrees 01 minutes 05 seconds West 143.12 feet; (2) thence South 00 degrees 47 minutes 36 seconds West 1153.73 feet; (3) thence South 55 degrees 56 minutes 44 seconds East 21.95 feet; (4) thence South 89 degrees 22 minutes 30 seconds East 1214.21 feet to the East line of said quarter, quarter section; thence along said East line, South 01 degrees 04 minutes 04 seconds West 74.11 feet to the North Limited Access Right of Way line of State Highway 62 East as described in Deed Record 99, page 404, recorded in the said Recorder’s Office, said point being North 01 degrees 04 minutes 04 seconds East 22.46 feet from a 2” pipe found 6” deep marking the Southeast corner of the Southwest Quarter of the Northwest Quarter of said Section 5; thence along said Limited Access Right of Way line, North 89 degrees 14 minutes 36 seconds West 1336.75 feet to the West line of the said quarter, quarter section; thence along said West line, North 01 degrees 07 minutes 09 seconds East 1320.02 feet to the point of beginning, containing 5.22 acres or 227,553 square feet.

Subject to all applicable easements, agreements, restrictions and right of ways.

Said location having an address of 6400 Caborn Road, Mt. Vernon, IN 47620

The public hearing for this proposed vacation of a public way or public place, specifically a portion of a Drainage Easement way will be held on the 18th day of November, 2025 at 9:00 a.m. in the Hovey House meeting room located at 330 Walnut Street in Mt. Vernon, Indiana.
